WHAT’S IT FOR?

A restraint of trade is a type of contract clause that can restrict workers from competing against their workplace. It’s generally part of an employment agreement or contractor agreement. If you are leaving your employer and looking to start your own business, it’s important to make sure you understand the risks under your employment contract, particularly as it is often not clear cut.

WHAT’S INCLUDED?

We will review an employment agreement or contractor agreement provided by you and provide advice around the key issues and risks of any restraint clauses.

This package includes:

  • Review of the restraint clauses in the agreement that you provide to us
  • High level written advice summarising the key issues and risks of the restraint clauses for you
  • Follow up phone consultations with you to take you through our advice and answer any questions you have about the document.

This package does not include a review of any other documents.

Please note that this package is intended to provide you with an understanding of the level of risk associated with the relevant restraint. However, the question of whether a restraint is enforceable ultimately depends on a number of factors and there is a rarely a black and white answer.
