Check The Setting As Well As The Service
cl 4.1, 4.2, 4.3, 4.4Coverage depends on both the activity and the setting. Off-site support roles and overlapping industries are the first filter.
- Check whether the work is actually done in the covered centre, class or coaching environment.
- Do not assume every worker near a gym, pool or tennis program falls inside the award.
- If the work is really clubs, hospitality, cleaning or another listed area, a different award may apply.
Set And Record Part-Time Hours Properly
cl 9.1, 11.1, 11.2, 11.4Part-time engagements need real written structure. In fitness businesses, that matters because split shifts and class based rostering are common.
- Part-time employees must have a written regular pattern of work.
- A part-time shift must be at least 3 consecutive hours, or 3 hours exclusive of meal breaks on a broken shift.
- Hours above the agreed or varied part-time pattern are overtime.
Apply The Correct Casual Engagement Rule
cl 12.1, 12.2, 12.3Casual rules are not uniform across all fitness roles. Payroll should distinguish general casual engagements from instructor and coaching exceptions.
- Casual employees have different loadings for Monday to Friday work and for Saturday, Sunday or public holiday work.
- The casual loading does not apply to overtime hours.
- The usual casual minimum is 3 hours, but certain instructor, trainer, tennis coach and trainee practical work classifications can be engaged for a minimum of one hour.
Roster Within The Ordinary Hours And Broken Shift Limits
cl 13.1, 13.2, 13.3, 13.4Fitness businesses often rely on split classes and peak periods. The award allows that, but only within strict broken shift rules.
- Ordinary hours sit within wide spans, including early mornings and late evenings.
- Ordinary hours average 38 a week over 4 weeks and cannot exceed 10 hours in one day.
- Broken shifts are allowed, but only in 2 parts, for at least 3 hours total exclusive of meal breaks, and within a 12 hour overall span.
Do Not Treat Rosters Informally
cl 13.5, 13.6, 13.7, 14Notice, recordkeeping and break settings are as important as the span of hours itself, especially where classes change week to week.
- Employees must be told their rostered hours and generally get 7 days' notice of changes, except in an emergency.
- RDO systems and make-up time can be used if they are properly agreed and recorded.
- Break rules sit separately and should be configured alongside the shift pattern.
Match The Level To The Work And Check Allowances
cl 17.2, 17.3, Schedule AClassification and allowances are closely linked in this award. A wrong level or a missed broken shift allowance can undermine an otherwise tidy pay run.
- Allowance issues commonly arise for leading hands or supervisors, broken shifts, first aid, overtime meals, vehicle use and uniforms or protective clothing.
- Schedule A distinguishes true entry level duties from higher level work such as unsupervised swimming and water safety teaching, more skilled customer service and coaching functions.
- Classification should follow the work actually being done, not a generic label like instructor or receptionist.
