Confirm coverage before payroll is set up

- Check the employer's principal function before assuming the award applies.
- Then check that the employee's work fits a customer contact, clerical and administration, or technical classification.
- If another award classification is more appropriate to the work and the environment in which it is performed, use that award instead.
Set the engagement type correctly
cl Clauses 8 to 12The engagement type changes how hours, overtime and minimum payments work. Record it clearly at the start of employment.
- Tell the employee whether they are full-time, part-time or casual.
- For part-time employees, use a regular pattern of hours and keep the arrangement recorded.
- Casual employees have a minimum engagement and a separate casual loading.
Use the roster rules rather than assumptions
cl Clause 13 ordinary hours and rostering, Clause 14 breaksThe award gives several ways to arrange ordinary hours, but they are not interchangeable. Rosters should be built against the award wording, not custom practice.
- Ordinary hours are averaged over the award work cycle and there are limits on daily hours unless the award flexibility mechanisms are used.
- There are specific rules for day work, notice of roster changes and day work flexibility arrangements.
- Breaks and any altered roster arrangements should be checked before they are rolled out.
Review allowances separately from base pay
cl Clause 18 allowancesAllowance errors are common because they are treated as optional or are bundled into a flat rate without checking the award.
- Allowances must be identified and paid separately where they apply.
- The award includes first aid, vehicle, telephone, meal and technical stream leading hand style allowances.
- Some technical stream allowances are paid for all purposes, which affects later calculations.
Use flexibility and salary arrangements carefully
cl Clause 3 NES and award, Clause 5 flexibility arrangements, Clause 17 annualised wage arrangementsAny simplified pay arrangement has to sit on top of the award, not displace it informally. Keep the NES and award mechanics in view.
- The award does not replace the NES.
- If you use an individual flexibility arrangement or annualised wage arrangement, the award conditions for doing so still need to be met.
- A flat salary is not a shortcut around classification, hours, overtime and allowance obligations.
Check overlap with other awards
cl Clause 4.6 overlap ruleOverlap issues are built into this award. They need to be tested role by role where the business has mixed operations or mixed functions.
- If the employer is covered by more than one award, use the classification that is most appropriate to the work performed and the environment in which it is normally performed.
- Do not assume a whole business sits under one award if different groups do materially different work.
