We review those clauses in context, because the commercial setting matters. A term that may be defensible in one arrangement can look much harder to justify in another.

That matters because unfair terms analysis is not only about harsh language on the page. It also turns on how the clause works in the real relationship. If the contract links to offers, promotions or pricing mechanics, the terms need to reflect the actual promotion mechanics and prize structure where relevant, rather than generic fallback wording copied from another business model.
It can be. Templates often carry over broad protective clauses from another industry, older legal precedents or a much larger business's risk settings. That can leave you with renewal, variation, liability or termination wording that does not fit the way your business actually deals with customers or small business counterparties.
