Notice of Intention to Defend

If someone objects to your registration or use of a certain trade mark, they can initiate proceedings. This is known as a trade mark opposition.

In some cases, businesses may choose to defend their trade mark in an opposition. To do so, you’ll need to draft and file a Notice of Intention to Defend to IP Australia to inform them of your decision.
