Frequently asked questions

Unsure about how we work? We have gathered the most common questions for your convenience.

Trade mark registration can be completed through IP Australia's TM Headstart program. Submitting a trade mark through Part 1 of the Headstart process is a quick way to get feedback from IP Australia about the likelihood of successful registration.

Between Part 1 and Part 2, you will receive the Headstart report from IP Australia. Part 2 of the application marks the beginning of the formal registration process.

As part of this package, we’ll apply to IP Australia to register your trade mark through TM Headstart Part 2, after our lawyers have submitted Part 1 and received a response from IP Australia.

This package includes submitting Part 2 of your TM Headstart Application, which involves applying to IP Australia for a 10-year trade mark registration.

This package starts at $900 + GST. This price includes application fees to IP Australia.

If you want to protect your business name, brand name, logo or catchphrase from being used by others, you should register a trade mark. Registration gives you the exclusive right to use the trade mark and can allow you to stop others from using it. Registering a trade mark can be a complex and technical process, so it’s a good idea to have a lawyer help you through it.
