Registering a trade mark with IP Australia is a common and effective way to protect your business’ intellectual property. Once your trade mark is registered, it’ll be listed publicly under your business’ name and anyone can search and identify your trade mark on the Trade Mark Search.
So, if anyone tries to use your registered trade mark without your consent, you can take legal action against them under the Trade Marks Act 1995 and follow a formal process with IP Australia.
However, registering (and renewing) your trade mark requires compliance with a specific process. For example, you’ll need to go through an opposition period which gives the general public an opportunity to oppose your trade mark application. For example, someone could oppose your trade mark application for being too similar to an existing one. In this case, your business would need to prepare documents and forms in response to these oppositions, and you’d need to formally defend your trade mark.
In some cases, businesses may choose to expand and conduct business overseas. This is where you need to think about how to protect your IP internationally. This involves a separate application process, so it’s important that you consult an experienced IP lawyer who can ensure you do it right.
