Registering a trade mark with IP Australia is a common and effective way to protect your business’ intellectual property. Once your trade mark is registered, it will be listed publicly under your business name, and anyone can search for it using the Trade Mark Search.

If someone tries to use your registered trade mark without your consent, you can take legal action under the Trade Marks Act 1995 and follow a formal process with IP Australia.

However, registering and renewing a trade mark requires compliance with a specific process. For example, there is an opposition period, which gives the public an opportunity to oppose your application. Someone might oppose your application if they believe it is too similar to an existing trade mark. In that case, your business may need to prepare documents and forms in response and formally defend the application.

If your business plans to expand overseas, you’ll also need to think about protecting your IP internationally. This involves a separate application process, so it’s important to consult an experienced IP lawyer to help you get it right.

Unlike traditional law firms, everything we do is on a fixed-fee basis. This means you will know the total cost of your legal bill from the start. Once you have accepted and signed our engagement letter, we will send you the payment details.

Please note that we take full payment upfront into our trust account. As set out in our engagement letter, your money will be held in our trust account until we have completed the scope of your project. To make sure your money is handled properly, we follow the rules and guidelines set by the Law Society of NSW for handling trust money. More information about trust accounts can be found here.

However, this can vary depending on how busy we are, any unforeseen complexities in your project, and your availability for calls or to provide the information we need. We will give you an estimated delivery time once we get started, and we will keep you updated if that timing is likely to change.
