Review international contracts

When it comes to international contracts, there are likely to be clauses that you’re unfamiliar with due to differences in laws between countries. This can be a tricky area to navigate, especially if you’re unsure about whether the contract can be enforced in Australia.

Contracts can be made to be internationally enforceable if you insert the appropriate provisions. For example, you may choose to include an international arbitration clause which sets out which country will settle disputes over the agreement and how it will take place.

Otherwise, in the absence of this clause, parties can also discuss and settle on the governing law and jurisdiction of the agreement. So, it should specify where the contract can be disputed if an issue or disagreement arises, and also specifies which country’s laws the contract will comply with.
